アメリカ全土でDACAの承認を受けた不法移民の若者は、約80万人存在する。
日本人もいる。タナカ氏の悲しい話です。

タナカ氏は日本生まれだが、2004年に「渡米」した。
彼はフィリピン人である母と、日本人である父と一緒に、
「旅行者のビザ」でアメリカに入国した。
彼が「渡米」した時はまだ6歳だった、にもかかわらず、
彼はアメリカという国に、すぐさま「“恋に落ちた”」ことを覚えている。
｢どういうわけか、アメリカを「故郷」のように感じたのです、
私はアメリカで生まれたのではないのに」。
子どもの頃も、「puberty」になってからも、
タナカ氏は自分が不法移民であることに明確には気づいていなかった。
しかし、両親にできないことが存在すること、
例えば、運転免許証を取ることや、家を買うことなどができないことには気づいていた。

タナカ氏の不法移民としての状況は、「大学へapplication」の機に明確になってきた。
社会保障番号や法的地位がない状況では、
FAFSA（「連邦政府」によるアメリカの奨学金制度）を申請できず、
連邦政府に「recipient qualification」を示すことができなかったのだ。
タナカ氏の場合は、「学業成績」が「優秀」だっため、問題が解決された。
ハーバード大学に「pass an exam」したので、
不法移民も留学生も応募可能な奨学金を得ることができた。
しかし、不安は常につきまとう。
｢高校で一生懸命頑張っていても、後々、仕事に就けないのではないかと思う時もありました｣
ハーバード大学では、タナカ氏は比較的、マイノリティーの「部類」に入る。
約6700人の学部生の中で、およそ40人に1人が不法移民の学生だ。
Business Insiderがハーバード大学に対してコメントを求めた際、
同大学はハーバード大学学長のドリュー・ファウスト（ Drew Faust）氏の文書を参照するよう伝えてきた。
文書の中で（ Drew Faust）氏は、ハーバードの全学生を支援すると約束し、
｢彼らに明確で率直な支援をしていくことを再度断言する｣と誓った。
タナカ氏は無事に卒業できたのだろうか?
2017年、ドナルドトランプ政権はDACA制度を段階的に廃止するよう命じた。
ところが昨年、カリフォルニア、ニューヨーク、ワシントンDCの連邦裁判所判事らがこの施策に反対し、
事実上DACAプログラムを継続させる裁定を下した。
これを受けて政権側は、現在、
最高裁判所に対して「reopening of a case reopening of proceedings retrial」を求めている。
ドナルドトランプ大統領、DACA制度を「存続」して下さい。
DACAプログラムを受けた若者はアメリカの強い「味方」になります。
タナカ氏も言っている。
彼は、「“恋に落ちた”」のです。彼はアメリカを愛しています。

私は、2つのことを「訴えて」います。
これは日本政府による「国際的」な「人権侵害」です。
私たちの「honorの回復と賠償」が行われるように、皆様のご支援をお願いします。
１．外国人が「在留の資格」以外の「違法な労働」を行った。しかし外国人は無罪です。
外国人だけが入管法７０条「違法な労働の罪」で処罰されました。
これに対して入管法は不法な労働の「因果関係」である雇用者を入管法７３－２条
（不法な就労を助長した罪）で処罰しています。
しかし、日本の司法は外国人のみを「処罰」しましたが、「雇用者」を「処罰」していません。
これは明らかに「法の下での平等の原則」に反します
そして「恣意的」に外国人だけを「処罰」することを禁じた国際法に違反しています。
違法に外国人を雇用した雇用者が「無罪」であるならば、違法に働かされた外国人も「無罪」です。
そうであれば、入管法70条に対する「刑法の他の犯罪を支援した者」は誰もいません。
「私、KinGungaku、フィリッピン国の外交官、フィリッピン大使館職員」は無罪です。
２．検察が「入管法22-4-4条の支援」を理由として、
入管法70条に対して刑法の60条および62条の
「他の犯罪を支援する罪」を「適用」することは「クレイジー」です。
これは法の論理が狂っている。
外国人が入管法22-4-4条
（虚偽の書類を提出することによるstatus of residenceの取得）に規定する行為を行った。
しかし、これに対する「刑事処罰」はありません。
処分は、法務大臣による「status of residenceの取り消し」と「国外への強制退去」です。
したがって「刑法の60条および62条の「他の犯罪を支援する罪」は適用できません。
「起訴状」が指摘する入管法22-4-4条の「犯罪の理由」は入管法70条とは因果関係がない。
まったく、法の論理が狂っている。
日本政府は「告訴」を「crush」ています。
しかし国家権力による「crush」は「Statute of limitations」の「停止」です。
